On the 7 of September 2021 FEDERFARMA, FILCAMS-CGIL, FISASCAT-CISL E UILTUCS-UIL signed a hypothetical agreement for the renewal of the National Collective Labour Agreement for Private Pharmacy employees concluded on 26.5.2009 and, partially, already amended in 2011.

The agreement reached must be submitted to the deliberating bodies of the respective trade union associations for final approval.

The social partners have committed, upon approval, to formalise the final text of the agreement for the renewal of the National Collective Labour Agreement by 31 December 2021. The new collective agreement will be in force until 31 August 2024 and will be tacitly renewed from year to year until it is revoked by one of the stipulating parties at least six months before its expiry date.

In the event of cancellation, the National Collective Labour Agreement will nevertheless continue to produce its effects until the date on which the next renewal agreement is concluded.

Below are the main changes:

WAGES AND REMUNERATION

  • From 1 November 2021, there will be an increase of € 80 on basic pay based on the 1st grading level.
  • On a trial basis and in order to provide an incentive for employees to carry out vaccinations to combat Covid-19, an additional fee of no less than € 2 gross for each vaccination carried out by the pharmacist is established; alternatively, the pharmacist may opt for an annual flat-rate fee of € 200 gross.

CONTRACTUAL WELFARE

  • A system of supplementary health benefits from the National Health Service is established for all employees of private pharmacies working under an open-ended contract, including part-time. The system will be financed by an employer’s contribution, starting from 1 November 2021, of €13 per month, for twelve months, which cannot be included in the remuneration used to calculate the TFR. The supplementary health care will have to be in force from 1 January 2022 in accordance with terms and conditions to be identified by the parties; failing this, the monthly contribution of €13 will have to be paid as a separate element of salary.

The employer who fails to pay the contribution as indicated shall pay the employees a non-absorbable amount of €25 for 14 months, as well as compensation for damages, without prejudice to the obligation to guarantee health benefits.

CLASSIFICATION OF EMPLOYEES

  • With effect from 1 of November 2021, the middle management category is divided into the following three professional areas, although they all cover equally demanding tasks:

Area Q1 – Head Director;

Area Q2 – Collaborating pharmacist who has acquired a high degree of specialisation, possesses specific technical-professional skills, also attested by successful participation in training courses, and performs one or more of the following duties: management of a specific sector or area (e.g. telemedicine, first-instance diagnostics, etc.) set up within the Service Pharmacy, when it is exercised with full and autonomous responsibility; responsible for coordinating services in pharmacies organised to provide a plurality of services;

Area Q3 – Collaborating pharmacist after 24 months of service in the qualification.

PAID LEAVE

  • For employees recruited from 1 November 2021 by pharmacy owners with up to 40 employees, the 40 hours of leave in addition to the leave resulting from the abolition of former national holidays will be recognised in the amount of 50% after 3 years from recruitment and in the amount of 100% after 6 years from recruitment. For the computation of the years of service, service in other pharmacies will also be taken into account.
